Effective upon electronic acceptance • Idaho and Federal Law
By registering a guest visit through this portal, you (“Member”) agree to the following terms, which constitute a legally binding agreement between you and Legacy Health and Fitness (“Legacy H&F”).
1. Member Responsibility
Member is solely responsible for the conduct, safety, and policy compliance of any guest (“Guest”) brought onto Legacy H&F premises. Member represents that the Guest has been informed of and agrees to abide by all gym rules, posted notices, equipment guidelines, and staff instructions.
2. Assumption of Risk
Member and Guest acknowledge that use of exercise equipment, free weights, and fitness facilities carries inherent risks including muscular strains, sprains, and cardiovascular events. Pursuant to Idaho Code § 6-904, participants assume the inherent risks of recreational activities. Member expressly assumes these risks on Guest’s behalf for this visit.
3. Indemnification & Liability for Damages
Member agrees to indemnify, defend, and hold harmless Legacy H&F, its owners, managers, employees, contractors, and agents from any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:
- the Guest’s presence on or use of the premises or equipment;
- injury to the Guest or any third party caused by the Guest;
- property damage caused by the Guest; or
- any violation of Legacy H&F rules or policies by the Guest.
This indemnification is in addition to any other obligation Member may have under Idaho law.
4. No Membership Created
This registration does not transfer, extend, or create membership rights for the Guest. The Guest is permitted on the premises solely as a single-visit invitee and must present valid photo ID upon staff request.
5. Guest Contact Information
Any guest email or phone number provided is used solely for facility records and, if the Guest separately consents, marketing communications. Phone numbers will not be used for autodialed or prerecorded messages without TCPA-compliant written consent from the Guest (47 U.S.C. § 227).
6. Governing Law & Venue
This agreement is governed by the laws of the State of Idaho. Any dispute shall be resolved exclusively in state or federal courts located in Gem County, Idaho.
7. Electronic Signature & Legal Effect
By checking the acknowledgment box and clicking “Register guest visit,” Member affixes their electronic signature pursuant to the E-SIGN Act (15 U.S.C. § 7001 et seq.) and the Idaho Uniform Electronic Transactions Act (Idaho Code §§ 28-50-101–28-50-120). This agreement is legally binding and enforceable to the same extent as a handwritten signature.
8. Severability
If any provision is held invalid or unenforceable, the remaining provisions continue in full force and effect.
