1. Acceptance of Terms
By accessing and using Legacy Health and Fitness services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Use License
Permission is granted to temporarily access the materials (information or software) on Legacy Health and Fitness's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
- Modify or copy the materials
- Use the materials for any commercial purpose or for any public display (commercial or non-commercial)
- Attempt to decompile or reverse engineer any software contained on our website
- Remove any copyright or other proprietary notations from the materials
3. Membership Terms
Membership Eligibility
To become a member, you must be at least 18 years old and provide accurate, complete, and current information during the registration process.
Membership Fees
Membership fees are billed in advance and are non-refundable except as expressly provided in these terms. We reserve the right to change membership fees with 30 days' notice.
Membership Cancellation
You may cancel your membership at any time by providing written notice. Cancellation becomes effective at the end of your current billing cycle, and you remain responsible for all fees through the cancellation date.
4. Facility Rules and Regulations
Conduct
Members must conduct themselves in a respectful manner toward staff and other members. Harassment, intimidation, or inappropriate behavior may result in immediate suspension or termination of membership.
Equipment Use
All equipment must be used properly and safely. Members are responsible for inspecting equipment before use and reporting any damage or malfunction immediately.
Personal Belongings
Legacy Health and Fitness is not responsible for lost, stolen, or damaged personal belongings. Use lockers at your own risk.
Hygiene and Cleanliness
Members must maintain personal hygiene and clean equipment after use. Violation of hygiene standards may result in suspension.
5. Payment Terms
All payments must be made through approved methods. We reserve the right to suspend services for non-payment. Late fees may apply for overdue accounts.
6. Limitation of Liability
Legacy Health and Fitness shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of our services. Our total liability shall not exceed the amount paid by you for services in the preceding 12 months.
7. Indemnification
You agree to indemnify and hold harmless Legacy Health and Fitness, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these terms.
8. Termination
We reserve the right to terminate or suspend your membership immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
9. Governing Law
These Terms shall be interpreted and governed by the laws of the jurisdiction in which Legacy Health and Fitness operates, without regard to conflict of law provisions.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.
11. Legacy Health and Fitness Member SMS Program
When you opt in to our SMS program, you can expect to receive informational and promotional SMS messages from Legacy Health and Fitness, including facility updates, class reminders, billing reminders, account notifications, special offers, and event announcements.
How you may opt in: (1) Online — during membership signup or onboarding you accept these Terms, including this SMS section; (2) Member portal — account preference toggles for service and marketing SMS where available; (3) In person — at our gym with staff-documented consent on paper or tablet; (4) Written forms — checkboxes on membership or waiver paperwork. A public summary of our SMS program and A2P disclosures is available for verification.
Frequency: Marketing/promotional messages — up to approximately 10 per month per subscriber. Transactional messages (e.g. billing, payment issues, account alerts) are sent as needed. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
You can cancel marketing SMS at any time by texting STOP to the phone number that sent the message (for programmatic messages from our system, typically our Twilio long code (208) 928-3888). We will send a confirmation. You may still receive limited account-related messages where permitted. To receive messages again, you may opt in through the member portal, onboarding, or as we describe in our SMS program page.

If you have any questions regarding privacy, please read our Privacy Policy, including the statement that mobile numbers and SMS opt-in data are not sold to third parties or lead generators for marketing.
